Chargeback Liability and Fee Provision
1. Acknowledgment of Receipt By purchasing goods or services from PowerEdge Outdoor Equipment (“Seller”), the customer (“Buyer”) affirms that all items delivered, picked up, or otherwise transferred into the Buyer’s possession are deemed received in good order, unless a written claim is submitted within the time period stated on the invoice or sales agreement.
2. Prohibition on Improper Chargebacks Buyer agrees that initiating a credit‑card chargeback for goods that have been delivered, received, or picked up constitutes a breach of contract. Seller retains the right to present delivery records, signed pickup documentation, surveillance evidence, and internal transaction logs in response to any disputed charge.
3. Administrative Fee for Chargebacks In the event Buyer initiates a chargeback for goods already received, Buyer shall be liable for a non‑refundable administrative fee of $45, assessed to cover investigation, documentation, and processing costs associated with the dispute.
4. Liability Following Chargeback Reversal If the chargeback is reversed in favor of Seller, Buyer remains responsible for:
- the full original purchase amount,
- the $45 administrative fee, and
- any additional bank or processor fees incurred by Seller as a result of the dispute.
5. Collections and Legal Remedies Any outstanding balance not paid within 30 days of notice may be referred to a third‑party collections agency. Buyer shall be responsible for all associated collection costs, including but not limited to agency fees, attorney’s fees, and court costs. Seller reserves the right to pursue civil remedies for recovery of merchandise, fees, and damages.
6. Acceptance of Terms By completing a purchase, Buyer expressly agrees to this Chargeback Liability and Fee Provision and acknowledges that these terms govern all transactions with Seller.
